Terms of Use

Acceptance

These terms govern your use of Stock Stats (the "app"). The app is developed and operated by Viacheslav Mukha, an individual developer ("we", "us", "the operator"). By downloading or using the app, you agree to these terms.

License

Subject to your compliance with these terms and the App Store Terms of Service, we grant you a personal, non-transferable, non-exclusive license to use Stock Stats on Apple-branded devices that you own or control, as permitted by the Usage Rules set out in the App Store Terms of Service.

Third-party services

If you use a third-party service through the app — for example connecting Interactive Brokers Flex Web Service sync — you must comply with that service's own terms, and it remains a relationship between you and that provider.

Maintenance and support

We are solely responsible for providing any maintenance and support for the app, to the extent required by applicable law. Write to support@stockstats.pro and we'll help.

Not financial advice

Stock Stats is an analytics and record-keeping tool, not a source of financial advice. Every figure the app shows you — returns, projections, goal estimates, risk metrics — is an educational estimate computed from the data you enter or import and from third-party market data. Nothing in the app is investment, financial, tax, or legal advice, and nothing in it is a recommendation to buy, sell, or hold any security. Past performance shown in the app does not predict future results.

Market data disclaimer

Quotes and historical price data come from third-party sources and may be delayed, incomplete, or inaccurate. They are provided "as is," for your personal informational use only, and are not intended for use in making trading decisions. You may not redistribute market data obtained through the app.

Your data and your responsibility

You own the data you enter into Stock Stats. The accuracy of any analytics the app computes depends entirely on the accuracy and completeness of the data you enter or import. You are responsible for keeping your own backups; the app provides export and optional iCloud backup for that purpose, but using them is your choice and your responsibility.

Subscriptions

Stock Stats Pro is an optional, auto-renewing subscription purchased through Apple and billed to your Apple Account. It renews automatically unless canceled at least 24 hours before the end of the current period. You can manage or cancel your subscription in your App Store account settings. The app includes a built-in 14-day trial of all features, run inside the app itself and not an Apple-administered offer. Prices are shown in the App Store at the time of purchase. Refunds are handled by Apple under its own policies; we do not process refunds directly.

Acceptable use

You agree not to reverse engineer the app except to the extent applicable law expressly permits, not to abuse or overload the market-data service behind the app, and not to use the app for any unlawful purpose.

Intellectual property

The app, its design, and its content belong to the operator. These terms do not transfer any ownership to you beyond the license above.

Disclaimer of warranties

To the maximum extent permitted by applicable law, the app is provided "as is" and "as available," without warranties of any kind, express or implied. We, and not Apple, are solely responsible for the app and for any warranty covering it, to the extent a warranty is not effectively disclaimed here. This does not affect any statutory rights you have as a consumer that cannot be excluded under the law that applies to you.

Claims about the app

We, and not Apple, are responsible for addressing any claim you or a third party makes relating to the app or your use of it — including product liability claims, any claim that the app fails to conform to a legal or regulatory requirement, claims arising under consumer protection or similar legislation, and claims that the app infringes a third party's intellectual property rights.

Limitation of liability

To the maximum extent permitted by applicable law, the operator is not liable for any indirect, incidental, special, or consequential damages arising from your use of the app, including decisions made based on figures the app shows you. Nothing here limits liability that cannot be limited under applicable law.

Apple as a third-party beneficiary

This agreement is between you and the operator only, not Apple, and Apple is not responsible for the app or its content. Apple has no obligation to furnish any maintenance or support services for the app. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app to you, if any; to the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the app. Apple is not responsible for addressing any claims by you or any third party relating to the app, including product liability claims, any claim that the app fails to conform to any legal or regulatory requirement, and claims arising under consumer protection or similar legislation, or claims that the app infringes a third party's intellectual property rights. You represent and warrant that you are not located in a country subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties. Apple, and Apple's subsidiaries, are third-party beneficiaries of these terms, and upon your acceptance of these terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these terms against you as a third-party beneficiary of them.

Termination

We may suspend or terminate your access to the app if you materially breach these terms. You may stop using the app, and delete it, at any time.

Governing law

These terms are governed by the laws of Ukraine, where the operator is based, without regard to their conflict-of-law rules, and the courts of Ukraine have jurisdiction over any dispute arising from them. If you use the app as a consumer, none of this deprives you of the protection of the mandatory consumer-law provisions of the country where you live, or of your right to bring proceedings in the courts of that country where the law gives you that right.

Changes to these terms

If we change these terms materially, we'll post the update on this page with a new effective date.
